To address fears from manufacturers that their proprietary in-situ products were not being discriminated against with regard to CE marking, the European Commission Director General has taken the opportunity to clarify their position despite the issue being legally and technically complex. Their position was stated as “the EC services consider that in-situ concrete road barriers based on a proprietary design which are commercialised as products to be installed on the road are construction products under the CPR and covered by EN 1317-5:2007+A2:20I2.” In addition, the European Commission’s reasoning was presented in the Annex to the letter giving detailed technical and legal arguments.
